Lottery of receipts, the obligation for merchants slips again

New extension for the obligation to update the telematic cash register to the software version compatible with the Lottery of receipts: what changes for merchants and what for users.

With the measure n. 83884 of March 30, 2021, the Italian Revenue Agency has once again postponed the deadline by which merchants must update their cash registers to a model (or software version) compatible with the Lottery of Receipts.

The measure saves thousands of merchants from the risk of a fine, since the obligation should have been triggered today, April 1, 2021, according to the provisions of the previous postponement measure issued on January 23, 2020. The new date by which cash registers must be updated is now October 1. For citizens, this means that a large number of stores will be able to continue to opt out of the Receipts Lottery, which, among the requirements for merchants, also has the cash register's telematic connection with the Internal Revenue Service, via the software in version 7.0 (version published in June 2020).

Telematic cash register: yet another postponement

That of March 30, 2021 is just the latest measure to postpone the obligation for merchants to bring their cash registers in line with the regulations.

While stores with a turnover exceeding 400 thousand euros per year are already obliged to have a cash register in line with the regulations from January 1, 2020, in fact, those with a lower turnover were initially required to comply by July 1, 2020.

This date was then moved to January 1, 2021, then to April 1, 2021 and, now, it has been moved to October 1, 2021.

Lottery of Receipts, what changes for those who buy

With the new measure of the Revenue Agency for buyers nothing changes from yesterday: they will continue to accumulate virtual tickets for the Lottery of Receipts only from purchases made at stores already in compliance.

Remember that, in order to generate virtual tickets, the purchase must be of an amount at least equal to 1 euro and the payment must be made by electronic method. In any case the purchase must provide for the issuance of a receipt, so do not generate tickets the purchase of tickets to the cinema, theater, museum or bus, parking payments or purchases online.

Not even valid purchases with tax deduction against the presentation of the health card, such as those in pharmacies. Né, infine, valgono gli acquisti effettuati a nome di una impresa o comunque con fattura e partita IVA.

Lotteria degli Scontrini, cosa cambia per chi vende

Per chi vende, e non si era ancora adeguato alla normativa, cambia invece molto: senza la proroga, infatti, da oggi sarebbe stato passibile di multa per il mancato adeguamento del registratore di cassa telematico.

Ricordiamo che è già presente, sul portale ufficiale della Lotteria degli Scontrini, una apposita sezione all’interno della quale gli acquirenti possono segnalare gli esercenti. Le segnalazioni possono essere fatte in due casi:

  • L’esercente non ha emesso (né su carta, né in elettronico) il documento commerciale (scontrino)
  • L’esercente si è rifiutato di acquisire il codice lotteria ma ha emesso il documento commerciale (scontrino)
