While home office is becoming more and more established, the legal basis for working from home is often opaque. Since there is no legal right to home office yet, an employee usually has to get permission from the employer for this.

Important criteria of a sample home office agreement

To avoid conflicts between you and your employer, it is important that a home office agreement contains clear specifications:
  • Term: The agreement must state whether working from home is temporary and, if so, for how long.
  • Home office equipment: the employee must have an office space corresponding to the occupational health and safety measures available.
  • Expense reimbursement: additionally incurred electricity costs and other additional expenses should be noted in the agreement.
  • Working hours: Since it is particularly difficult in the home office to check the exact working hours, this must be clearly defined in a regulation.
  • Data protection: The employee must also assure the employer that all confidential data in the home office are safe from misuse.

Zugangsrecht des Arbeitgebers in einer Home-Office-Regelung?

Grundsätzlich darf ein Arbeitgeber vor Beginn der Tätigkeit im Home-Office den Arbeitsplatz begutachten, um sicherzugehen, dass dieser den notwendigen Anforderungen entspricht. Hierfür muss sich der Arbeitgeber jedoch mindestens 24 Stunden vorher ankündigen.
