Home Office: Workplace Ordinance - what is it?
The home office is no longer imaginable without it. So that the basics for home office are also regulated by law for employers and employees, there is the so-called "Workplace Ordinance". This regulates everything that is important for the topic of home office.
This is what the Workplace Ordinance says in the home office
The Workplace Ordinance is primarily aimed at safety and health protection for the employee. The focus is particularly on setting up and operating workplaces. In order to prevent accidents at work, there are therefore special guidelines to which the employer must adhere. In this way, workplaces are to be improved and work processes optimized. Even in the home office, it is therefore important to pay attention to one or the other detail.- The employer must equip the employee for work in the home office with all things that allow safe work at home. This includes communication devices such as telephones, computers and printers, as well as furniture and other work equipment. This currently applies only to teleworkplaces.
- Mobile working is not subject to the Workplace Ordinance so far, because the principles for the home office have not yet been sufficiently defined.
- Geschieht während des Arbeitens zuhause ein Unfall, dann hat die Unfallkasse nur dann dafür aufzukommen, wenn dieser im eigentlichen Arbeitsbereich und nicht im anderweitigen privaten Umfeld geschieht.
- Es empfiehlt sich daher, für das Home-Office vorab eine genaue Regelung mit dem Arbeitgeber festzulegen und diese schriftlich zu fixieren.
