Filming in public - is that even allowed?

Nowadays, photos or videos are taken in public again and again. Usually, people do not think about whether this is allowed at all. Basically, you are not allowed to film people without their permission. However, there are also various situations where there are exceptions.

This is allowed when filming in public

If you are traveling in a new city, you usually take photos of the buildings. Inevitably, strangers are usually seen on them. It is the same with filming. In some situations this is allowed, but not always.
  1. You are only allowed to film people if you have their consent. For people under 18, you also need the consent of the legal guardians.
  2. The situation is different if you film or photograph a landmark as a tourist. Here, people inevitably appear in the background. This is also the case with meetings, parades or other major events. In general, pictures and videos are allowed at special events.
  3. You make yourself liable to prosecution, however, if you record a video of a person and then put it online on a social media platform. For this you need the consent of the persons.
  4. Also, buildings may only occur in your video if this is located on a public street. However, you may also not film the inside of the building or record through a window.
